California’s Safe Drinking Water and Toxic Enforcement Act of 1986, commonly referred to as “Proposition 65,” requires “clear and reasonable” warnings about potential exposures to certain chemicals that California has determined cause cancer, birth defects or other reproductive harm.

The agency charged with administering Proposition 65 has promulgated new regulations governing these warnings, which go into effect on August 30, 2018. In addition to providing new “safe harbor” warning language for retail sales of products creating exposures to a listed chemical, the new regulations also explicitly require warnings to appear in catalogs and on e-commerce sites.  These warnings must be “clear and reasonable,” and must be provided to consumers in California prior to purchase.

We are asking that you complete this form  on or before August 30, 2018. Please complete the form acknowledging the receipt and understanding of this information.

(Herein “Magnolia Brush”) requires your confirmation electronically, or in writing, of receipt of this notice.  To request a hard copy please email prop65@magnoliabrush.com. If Magnolia Brush does not receive confirmation of the acknowledgement, we may unable to ship products for sale in California to you after August 30, 2018.  If you decide not to return this form, you are agreeing not to sell products purchased from Magnolia Brush in California.  If you do sell Magnolia Brush products in California without returning this form, Magnolia Brush cannot be responsible.
