As a recognized distributor of Magnolia Brush Mfrs., Ltd products, this correspondence provides notice pursuant to California Health and Safety Code section 25249.5 et seq. (“Proposition 65”) and 27 CCR § 25600.2(b) (effective 30 August 2018).

The products indicated below with a Magnolia Brush Mfrs., Ltd SKU number, and description, require a Proposition 65 warning for any sales into California.

Magnolia Brush will provide the necessary warning on listed products shipping direct to California. If you sell or feature the products on your website or via catalog or other printed materials, you must include the warning language below on your website, printed publications and on any listed products shipped by the distributor into California.

The warning language for listed products sold must be shown to the online consumer prior to completing the purchase. You should do this by including either the warning or a clearly marked hyperlink using the word “WARNING” on the product display page, or by otherwise prominently displaying the warning to the purchaser prior to completing the purchase. The warning placed on your website and/or in your printed materials should be identical to the warning provided on the product packaging.

As a condition of distributing Magnolia Brush products:

1. The recipient of this notice acknowledges that it is an authorized agent, for purpose of complying with Proposition 65. Under the Proposition 65 regulations, this means that the distributor is designated by any retail seller to receive notices from product manufacturers, producers, packagers, importers, suppliers, and distributors under this article.

2. The distributor agrees to provide Proposition 65 notices to any downstream seller including retailers or other suppliers to which they are redistributing Magnolia Brush products.

3. The recipient agrees to indemnify and hold harmless Magnolia Brush for any liability if the distributor fails to provide the Proposition 65 warning (provided by this notification). This includes sales to their authorized retail seller or other downstream entity. Distributor also indemnifies Magnolia brush if the retail seller fails to provide the notice.
